Children's & Minors' Privacy
TransparencED is a tutoring service for students age 13 and older. This Notice explains how we handle the personal information of the minors we serve (students under 18) and our commitment not to knowingly collect information from children under 13. We honor the protections of the Children's Online Privacy Protection Act ("COPPA") and the FTC's COPPA Rule, 16 C.F.R. Part 312, by not knowingly collecting personal information from children under 13.
1. We do not knowingly collect information from children under 13. This Service is not directed to children under 13. We ask users to be 13 or older, and we do not knowingly collect personal information from anyone under 13. If we learn that we have information from a child under 13, we disable the account and delete that information. Because we do not knowingly collect information from children under 13, we do not seek verifiable parental consent under COPPA to do so.
2. What we collect from students. For the minors we serve (students age 13 to 17), we may collect: account information (first name, last name, grade level, school, time zone, and a tutoring goal if provided); the audio of live tutoring sessions, which we record; written transcripts generated from that session audio; documents the student or their tutor uploads and messages the student sends in session chat; and usage information. We collect a student's date of birth solely to determine age and apply the protections described in this Notice. We do not record video of sessions.
3. How we use students' information. We use a student's information to provide the tutoring service for that student's family — generating session transcripts, learning summaries for the student's tutor and, where applicable, their parent or guardian, and interactive practice with answer-checking. Our software (including the automated assistant we call "Iris") analyzes session transcripts to estimate what a student has mastered and to automatically steer what the student practices next, and it may infer engagement or emotional tone from session content. These are automated processes that support — but do not replace — the student's human tutor. We do not use students' information for behavioral advertising, and we do not sell students' personal information.
4. Disclosure to service providers. To operate the service, we disclose student information to vendors who process it only on our instructions and only to provide the service, under written contracts that prohibit any other use: Amazon Web Services (session hosting, audio-recording storage, and speech-to-text transcription), Anthropic, PBC (AI processing via the "Iris" assistant), Google (only when a student chooses "Sign in with Google" as an identity provider), and our email and SMS providers. Session audio and transcripts that may contain a student's voice and words are disclosed to Amazon Web Services and Anthropic for these purposes. Our AI service providers are contractually prohibited from using this data to train or improve their own models.
5. AI model training and cross-organization analytics. We do not use students' personal information to train, fine-tune, or improve machine-learning or AI models, and we do not include students' data in any cross-organization or aggregated benchmarking analytics. Our AI service providers are contractually barred from training their models on this data. If we ever offer an optional program that would use student data differently, it would be off by default and we would describe it and seek the appropriate consent before enabling it.
6. Your rights. A student, or their parent or guardian, may ask us to: (a) review the personal information we have collected; (b) stop further collection or use; (c) delete that information, including session recordings and transcripts; and (d) withdraw any consent previously given. To exercise these rights, contact privacy@transparenced.com. We may verify your identity before acting on a request.
7. Data retention. We retain a student's personal information, including session recordings and transcripts, only for as long as reasonably necessary to provide the tutoring service or as otherwise required by law, and we delete or de-identify it when it is no longer needed for those purposes. A student, parent, or guardian may request earlier deletion at any time. We do not retain students' personal information indefinitely. 8. Operator information. The operator collecting and maintaining student information through the service is TransparencED, Inc., 2622 Little Kate Road, Park City, UT, privacy@transparenced.com, (435) 901-4089. Where a tutoring business or school directs the use of student records, that organization is a co-operator for its students.
9. Changes to this Notice. If we materially change how we collect, use, or disclose students' information, we will update this Notice, revise the "Last Updated" date above, and provide any additional notice required by law.
